BJP and its future in Andhra Pradesh

Some of my friends on internet wanted BJP to grow in AP. I just put the question how? At one point of time BJP had 4 Lok Sabha MPs from A.P. But there were no efforts to build on it. It got less than 2% of the votes polled in 2009 elections. From such a bad condition how to make BJP a dominant force in entire AP is the question. In the native village of Venkayya Naidu its former national president and present general secretary, BJP did not get even a single vote in the 2009 election. This summarizes its position in AP.



The present leadership seems to think Telangana agitation role is the answer for that. I have extensively worked for BJP during Ramjanmabhumi agitation period when it was in main opposition in Delhi and had little presence in AP. Even in those days there is no effort from the Top leadership do build the party to the level of TDP and Congress in AP. But it found an idea of Ramajanmabhumi agitation and could mobalize people and workers in a major way. Now there is no such idea with BJP.

The level for stupidity in the present day BJP leadership can be seen from the recent BJP state level leadership instructions to Non Telangana district units to take up Jai Andhra agitation. It only goes to show how disconnected they are from popular mood in Non Telangana districts and also in Hyderabad City.

They want to ride high and come to power in any future Telangana state on the basis of their support to division of AP. Good. But they failed utterly to understand such stand will be very very costly in rest of AP. Congress and TDP with all their cunningness, ground level network and understanding of AP conditions clearly see it. But BJP is completely ignorant of this reality. BJP as a national level party can not ignore any area in the country if they really want to come back to power in Delhi. Yet it is ready to completely ignore its future the Non Telanagna areas in AP.

It is one thing to support small states on principle for which they may face less backlash If BJP is doing some agitation for division of AP in Telangana areas independently then also they may escape with less cost than their present association with KCR and his so called JAC. To support Telangana along with KCR and his gang and share platform with naxals like Gaddar is sheer stupidity. When the Tankbund demolition was done with KCR gangs, BJP had to give an apology for the same. It should have realized at least then that it is following Neo Razakar forces in Telangana.

Having gone with KCR, BJP never even tried to be critical of the “Andhra Bhago” slogans of KCR and its Telangana local leaders speak the same language of TRS in attacking Non Telangana people in AP. BJP can not be part of hate campaign in Telangana and go to costal districts and Rayalaseema and expect to get their votes. In fact it has no face to show in most of AP as of now. That is why Advani could not even come to non Telangana areas in AP in his recent yatra. Sushma Swaraj with her Ballary mining links participating in Telangana meetings and the discredited leaders of past like Advani taking of Telangana (after saying it is not possible while he was Home Minister) will only show how bad BJP is managing its efforts to grow in AP.

Had BJP tried to do any independent agitation for division of A.P. and had it from the start opposed the KCR and his attacks on Non Telangana people and his hate campaign it would have placed itself better in entire state. Further it simply forgot that its core base in Hyderabad city comes from Non Telangana people living there. Yet it had irreparably damaged its cause in the twin Cities because of its association with KCR. Now if Kishan Reddy contests from Hyderabad city he may face serious defeat. How you can possibly gain in entire AP by making almost 200 MLA seats out of 294 seat out of reach for next 10 to 15 years because of its badly managed role in Telangana?

The promise of Sushma Swaraj that they will give Telangana within 3 months of getting into power also is quite surprising. Will such division without state assembly consent be acceptable to Shiva Seena for example? Will it’s other possible allied AAIMK ready for such action? Further it likely they may need TDP just like last time to form the government in 2014. TDP is most likely to get those MPs from Non Telangana areas only. Will TDP support AP division in such conditions? By the way TRS will never gang up with BJP as it is a covert congress operation badly gone wrong (and seems to have become uncontrollable.)

Even if AP is divided, in Telangana, congress and TDP are quite strong. TRS will be a major force at least for a short time (before its merger into Congress that is) BJP to grown there even with their support to Telangana agitation will be quite difficult. It has no money and its organization may not be match to that of Congress or TDP. It will not be given any credit for creation of Telangana state. All the credit of statehood if it is formed will go to KCR and his TRS. So it can only expect marginal gain in short term and no gain in long term in Telangana.

First thing BJP needs in AP is an idea just like NTR idea of Telugu pride and self respect. It does not have one and has no capacity now to bring some thing like to forward. Present idea of division of AP already created a condition that it became a non entity in most of AP. The second thing it needs is money power. It simply does not have money power A.P. There are no Gali brothers to finance it in AP. Many of BJP district Presidents and General Secretaries do not even own a car. Can such people take on money bags of Congress and TDP?

If it can only have an idea capable of mobilization of all the nationalistic people in then it can get money power also because then people with cash will see it as a force and start investing in it. As long as it does not have any idea and can not mobilize people on such idea it will be 2% party in AP.

I am of the view that only by aggressively taking up the Hindu cause in the AP BJP can grow fast. There is serious Evangelical and Jihadi efforts to convert Hindus all over AP. Leaders like YS Jagan are part of this gangs and congress is also part of this gang. Most of the Hindus can see this. Yet BJP does nothing. They had serious chance when Delhi wanted to take over the Thipulathi Thirulama management. Yet they have not utilized such an emotional issue. When Rajagopuram of SriKalahasthi constructed by Sri Krishna Devaraya collapsed and also when Bhavanarayana Temple Gopuram collapsed it has a chance to show how bad the Congress Government is treating Hindu religious places. Yet it did nothing. Now they have to search for openings which are emotional to Hindus in AP and if they are committed they will find some soon and they have to exploit it seriously. Building Hindu vote bank just like in Mangalore belt in Karnataka state will be the only way forward for BJP in A.P. In short they need to do what Advani (when he had some credibility) did with Radhayathra in Indian politics. There is no one in AP BJP leaders doing such things. Venkayya Naidu ran away from AP and is happy being Rajya Sabha MP from Karnataka and rest of the leaders are now regularly seen with KCR or with Gaddar playing their number two side hero role. With this kind of leaders at present BJP can not hope to become a major player in AP in near future.

Telangana Autonomous Counsel ?

Today Daily Pioneer has reported that the Congress top leadership has decided to give an autonomous regional counsel to pacify the Telangana agitators. If this move is proved to correct then it will pacify few people in the hardcore Telangana agitators for the time being. But it all depends on the local government and how they will manage the aftermath of any such announcement. Kiran Kumar Reddy has proved his “management” capabilities by rolling back the “ sakala janula Samme” within some two weeks of getting clear mandate from Delhi. Already he has succeeded in dividing the Telangana MP’s and Ministers from Telangana region. Most of the MLA’s are not going to quite their position and those who joined TRS recently also will come to regret their decision if there is no immediate division of the state. TRS and KCR may be happy inward as they can continue their collection of hafta from Hyderabad for some more time. Chandra Babu was never actively pro division and agitation by Telugu Desam may slowly lose its shine. Jagan can be managed with CBI and money from Hyderabad Businessmen will help Congress to retain the power till next elections in 2014. TDP also not interested in elections right now as Jagan and TRS make the outcome uncertain. I do not thing CBN will risk elections in immediate future. Next elections will make or break his future. If he loses then it may be impossible for him to continue at the helm of affairs of the TDP. So he will be careful. Come 2014 Congress has a chance in most of the seats except Jagan continues to be factor.


Difficult but not impossible task before Congress leadership if it decides to go for autonomous counsel.

Is KCR taking on Congress High Command ?


For the first time in two years KCR is taking a step which is not a drama by Congress is directly against the interests of Congress party in the state. Today 3 MLA’s of congress are expected to join TRS as per the media reports.
Italian gang seems to have asked the CM, APCC President Botsa Sathyanarayana and Jana Reddy to stop the same. Some 6 congress MP’s are said to be willing to join TRS and may join the same soon. At least two names are out. Manda Jagannadhan (who was in TDP for a long time and jumped to congress during 2007/8 no confidence vote due to “management” done by YSR) and Rajayya. This is the first time in two years KCR is taking on congress high command openly. Why is this action at this state when just few days back his people were awarded the Polavaram dam contract work worth thousands of crores. New Drama by Congress??? May or May not be.

Since the death of YSR KCR and his gangs were targeting TDP and CBN and were acting as Congress B team. Therefore the present desertion of Congress MLAs and their joining of TRS may be a drama of Congress High Command or it may even be a case of  KCR going out of control also. If it is later then serious rethinking will be there in Congress High Command on the division of the AP state. We all know that KCR had too big ego and can not be trusted to be loyal to any one. Congress can only control him if they have goods on him to contain/control him through with CBI investigations. But megalomaniacs like KCR can not be made to see reason so easily. In any event the desersion of congress MLA’s to TRS will have serious bearing on the Congress decision on AP division. There is no need for congress to divide the state if TRS is going to be benefited in Telangana and Jagan and TDP in rest of AP.

Since the last 3 week Congress High Command is trying to take control the party and political conditions in AP slowly. The manner in which the Sakala Janula Samme was contained within 2 weeks of the action on rail rook is an indication that Congress can contain this agitation if it wants. November is declared as welfare month and Rachhabanda programme is going to start all over the state. Huge distribution of benefits worth about 3,500 Cr are to be made in one month. Some 15 MLA’s who are first time elected leaders who are joined the CM and started to go slow on T agitation. There are also huge no of ministry positions and board which are now being offered to leaders who show loyality to the leadership.  If there is any problem needing change of CM then DS Srinivas may be made a CM which will largely contain the T agitation. He is now made an MLC agaist the recommendation of the CM and APCC President.  Once the congress takes the situation in their control then congress will have option to deal with the matter.

But KCR and Jagan are now trying to create difficulties to the Congress and deny it the freedom to take most politically suitable ( to congress) decision. One side KCR is engineering defections from Congress to TRS and Jagan’s Chamcha Komatireddy Venkat Reddy is starting hunger strike till death from 1st November 2011.

Strong political leadership in AP is need for the congress in immediate future. Any weakness or even indication of weakness will cause irreparable damage to the Congress. There may be even huge desertions to TRS in Telangana areas and to Jagan criminal gang in non Telangana areas. There is already so the gang war in congress between loyalists and extreme T gangs. There is no way of predicting is there is any weakness or wrong decision on the division of AP.

There is still uncertainty and no outright gain in site to congress in taking any decision.

Now the appeals on before Supreme Court. These cases are first appeals in the civil side. Allahabad High Court has acted in the original side and conducted trail and gave judgement. In the first appeals, as per the civil law of India, both evidence and legal position will be heard and examined once again. Normally no fresh evidence will be allowed to be introduced in the appeals. i do not see possibility of some important and previously unknown evidence coming up at this stage. So Supreme Court has to hear what ever material what is there on record.


In this condition all the gurus who has examined the entire evidence here can reassess the same and see if any different conclusion can be drawn on the same material. My dirty communal mind says that it is not so easy. There is several legal issues are there and there is always possible to reach different view. But with serious defects in the evidence I do not see how Jihadi case will servive.

My view as an advocate for 6 years before AP High Court and as a Legal advisor for some 12 years after that is

1. The case of the Jihadists has considerably weakened with their admission that they agree that Hindus belive that Ram is born in the present Ayodhiya city. They have initially disputed the same in the written statement. With this the Hindus need only prove there is some temple etc and a particular place is believed to be Janmasthan. For that there is sufficient material for that.

2. The disputes on the site are known well and there is considerable material to show that. There was no uncontested and peaceful possession to Muslims till 1948/9 at any given point of time. Further their suit is hopelessly to time barred.

3. Jihadi forces have their worst enemies in our Jholawala brigade and AMU/JNU historians who do not know their difference between A*s to elbow in the history and never tried to learn it. You can see a Doctor in History saying that Prudhvi Raj is the ruler of Afghanistan in this case. What else you need to lose?

4. Jihadis never accepted that there is strong case for Hindus. So I wonder they make any better effort in the appeal. I wonder any Senior Advocate will tell them on the face that that they are facing serious problem with the lack of evidence and the streamnth of Hindu evidence. Jihadis simply can not accept that. They are now thinking that the

is somehow made a serious mistake and there is no material to support Hindu case. It is just like 9/11 is a Jew thing.

5. It takes lot of effort to conduct the case or an appeal of this nature. Lot of support is needed to be given to the advocate in supplying the material etc. Civilisationally , this is the first time in the History of Islam, Jihadi forces had to prove their right for occupy a place before a non religious court. I think they are not capable of effectively doing that. Arguing for truth takes lot of practice and social and cultural background and they as group do not have it. They need no prove anything as true as long as their have big swords and now they all believe their side is correct and rest is western conspiracy.

I have not gone minutely into evidence and these are my views on the weaknesses Jihadis as litigants have and I am of the view that much time these weaknesses play decisive role in the litigations. Gurus can correct me

Reforming Criminal Judicial System as a whole needed than one Lok Pal.  

I had to attend a civil case in Bangalore City Civil courts recently and I saw that the special court constituted for prosecution of Jayalalitha is still there working. If this is the state of affairs in a state like Karnataka, one can imagine the condition in states like UP. Further all the years taken for prosecution of political leaders is creating a situation wherein public thinks that all political leaders are criminals. This kind of perception is very bad for democracy. When we can effectively prosecute and convict all criminals be it politicos, be it corporate big wigs, be it Mafia leaders, bandits and jholawala and media traitors in a reasonable time then there will be freedom from criminalization of the politics and corruption. With Lok Pal we are only creating one more office without addressing the serious issues relating to the criminal justice system. Unless these basic issues are addressed the issue of criminal activities of politicos will not be effectively solve.  Cure therefore needed to the malady which is failure of criminal justice in India and not to a symptom like criminalization or corruption in political system. I agree that corruption do need specific steps. But it should be done in a all round effort to root out crime and not as a isolated condition.

Whenever some serious offence takes place, our politicians and so called intellectuals. Say “Law will take its own course” as if it is some uncontrollable chemical reaction.  Being associated with Legal profession for about 2 decades I say that the present state of affairs in Judiciary are no different from executive or legislature and the statements like law taking its own course is a gross misrepresentation of the actual situation. Few agree but will not actually realize how bad this situation is. I my self followed up a criminal case under CBI investigation since 1986.

In many states it takes decades for a criminal court to hear a case. There are no judges and courts in the required number in subordinate courts in the first place. Therefore the main problem for the “law to take its own course is the shortage of judges in the subordinate judiciary. 90% of the litigation is managed by Subordinate courts and you will be surprised to know that the total number of judges in our country is around 14,000. As per the Law commission’s report this number should be increase by 5 times. No action is taken on that till date. To be fair with Union Government they did try to bring a proposal for Indian Judicial Service, but there is no consent on the same from various states.

Unfortunately by Subordinate courts come under the State list and most of the states don’t give a damn about these courts. With the kind of political leadership we are having in various states it is difficult to expect improvements in near future. The proposal to create All India Judicial Service is mainly stalled because of the opposition from the states. Should the present structure of the subordinate courts which has not kept pace with the national requirements, mainly due to indifferent and negligent attitude of the states, to be allow to continue? I think not.  A national level judicial cadre with proper recruitment procedure like civil services and year after year recruitment filling all the vacancies will serve the nation well. In case of need there can be constitutional amendment for this purpose. Even otherwise there are Accident Tribunals, Banking tribunals, CBI courts etc can always be staffed with AIJS officials. This will reduce the work on regular courts and will give more time for them to hear criminal and civil matters. Further I am very much sure that the Supreme Court or High Courts will support any sincere effort by the Union Government to recruit and staff courts with well qualified people in a transparent and proper manner.  In fact Supreme Court time and again rooted for it.

Few years back I read that the total FIR’s filed in India in a year is about 6 Lacs. With 12000 Judges working in full time I think we can deal with these cases at trail stage and also hear appeals at the first level with in 3 months of filing a charge sheet.   If we need to spend about 25 Lacs (actual amount will be much less than this) per court per year towards all the staff salaries and other establishment expenses we can have some 12,000 criminal courts exclusively for a cost of Rs. 3000 Cr per year.  Most of the cost can be recovered from fines also. So the cost is virtually nothing. Even if infrastructure is to be created it will not cost a one time amount of say Rs. 12,000 Cr.

Very few will appreciate the effect such fast delivery of justice will have on the society. Many of the criminals have multiple offenses pending against them. Once we put a system on place wherein fast trial and punishment is given and once they go to jail in no time the charm of criminal life will be substantially reduced and the confidence of the public in the judicial process will also increase. With criminals being in Jail there will be less scope for criminalization of the politics. Further during faster trial also ensure that crimes are in public memory and therefore pressure will be there on the police etc to conduct the case for prosecution properly. Once it is clear people called as witnesses are also not required run behind courts for years and when there is hardly any time to manipulate or threaten witnesses common people also will be more willing to come forward as witnesses etc and help the prosecution.

One important provision in criminal law which needed to be urgently deleted relates to suspension of sentence. There is provision in Criminal Procedure Code wherein a sentence passed can be suspended during appeals time. During the period of suspension the convicted is free to wander in the streets.

Most of the criminals make use of this provision and get their sentence suspended. In the appellate court they drag the appeals for years while roaming freely outside. There is no fear of initial conviction and no fear till the final appeal is decided by Supreme Court which may take decades and persons will die by that time due to old age. So what is the use of giving conviction if you can not make the convicted under go sentencing? The best example of this situation is that of this traitor Binayak Sen. He is convicted by the Trial court for sedition and now came out without getting the conviction overturned because his sentencing is suspended.  No one could have found fault with the system if the High Court or Supreme Court finds that there is not much evidence against him and release him. But to suspend sentence of such person is quite wrong. I do not know how Supreme Court in its wisdom did this.

Other legal reform needed to be done is the removal of provision for concurrent serving of sentences. At present if a person is sentenced for 5 years to one offence and say 3 years for another, normally courts order him to under go both the sentences concurrently and as a result he will only serve 5 years in prison. We need to remove this provision so that such persons will serve 8 years that is first 5 years term and them a 3 years term. Similarly limiting life sentence for 14 years is also should done away with and made a long time like 30 Years or ideally remainder of their convicted persons natural life without any chance for remission etc. With this, courts will find it much harder to award death sentence.  

In the administrative level is the limitation on the cases listed every day and also the cases in active list before any single judge.  At present many judges get some 100 plus cases listed before them every day. Lot of time of the court is wasted due to the same simply in adjourning the cases. Further it is also causing lot of inconvenience to advocate, public, police etc.   Instead of that if every day is divided into morning and afternoon sessions and only 3, 4 cases are listed in a session lot of time will be saved and lot of convenience will be there to public at large.

Lastly capability levels of the people who are taking up the legal profession are pathetic. It good that Bar Association has now started a separate Bar exam. In fact we seriously need an exam in the mode of CA, ICWA or CS to improve the standard. Without increasing the knowledge and capability levels of the legal professionals there can not be any reforms.

Tackling Corruption

Part I – Political reforms.


For the last couple of weeks we are all treated to a great TV show with many popular features of Gandhian Ideal, Communist and Gora funded NGO nautaki, and endless politician bashing. Since IPL started the entire show got shifted non prime time slot.

There is no doubt Corruption is a very serious issue and needed to be immediately otherwise we will be jumping from License permit kota Raj to Crony Capitalism. ( I think we are already there and soon it will be too late to reverse the condition.) We need to looking to the reasons for the present state of affairs.

Many will agree that the manner in which the elections in India conducted is the root of the corruption. There are many structural changes which are needed to be implemented. First we need to ensure or even enforce wider participation in the electoral process. Voting shall me made compulsory.

Restrictions against the public servants at least people working in PSU’s and certain sections of the government servants like teachers, doctors etc shall be removed. Most of the educated class which is presently forced to keep out of politics will then have an opportunity to participate in the elections.

All public servants (may be except Army, police, Judges Etc) should be allowed to be political party members. We are no longer having colonial rule and there is no reason why merely because a person is a public servant he/she should not participate in political activity.

Internal party democracy shall be enforced by law. All party positions from village level to national level shall be elected by common party members in yearly direct elections. Election commission shall supervise and conduct and these elections. Candidates for MLA and MP seats shall be elected by the local party members and not nominated as now.

There shall be open election of the legislature party leaders and CM/PM once elected shall be only be removed by constructive majority. Sitting MLA’s MP’s shall be given automatic right to contest elections on their party tickets so that they are free from party bosses.

Time also has come to think if we can elect CM/PM directly so that they can have affixed tenure and will not be exposed to blackmailing as now. Local body elections and their powers are now left to state governments which are not at all allowing their functioning. There shall not be any indirect elections or nominated posts like Governors, Rajya Sabha Members and even these people shall be elected directly by people.

Entire constitutional scheme relating to the local body elections, administration, and powers is to be revisited. All the local governments shall have proper periodical elections under the central election commission. Powers of the local governments shall be fixed and shall not be interfered with.

Restrictions on family members participating in elections, limited terms, age restrictions etc are also some of the methods which will naturally allow vide participation in the political process.

Many of the above like internal party democracy, local governance etc are there in all most all the democracies of the world today. There is no reason why we can not adopt the same here.

Public financing of the elections, paying salaries to the elected political party workers at certain from public funds are some of the steps that will also help reduce corruption. Once the political parties are made more structured as above this should not be a problem to put in place.

Tamasha on TV

The tamasha of World cup cricket is over and suddenly our Tv newswalas find there is nothing dramatic to report. The campaigne for Bharat Rathna for Sachin seems to be going nowhere ( Stupid people like my self may ask why not give it to Viswanathan Anand whose achievements of being 3 times world chess champion is perhaps the greatest sporting feet from our nation for the last century)

There are no sensational murders in the Noida area to give 24x7 coverage. Elections are so boring and upper middle class is not much interested in that. In this very bad and dry situation a god send opportunity has come to then in the form of an agitation of Anna Hazare and our news gangs are now all over it.

Suddenly all our friendly neighborhood communist jholawalas, un/under employed filmwalas and Magastars ( mainly staring in advertisements) out to grab TV time are all are now fighting like female wrestlers in a mud pit to get their face and their two bit sermons to the nation on TV.

All kind of social networks in cyberspace are full of lazy people like myself making short statements. Media bhai log are all following which 3rd page personality twitting what and instantly putting on their paper/tv web pages.

School children are also brought to the Janthar Manter and asked to speak about corruption and how it should be eradicated. (Frankly I have no objection for a 10 year speaking as he/she has all the honesty and more knowledge/concern than Amir Khans of this world)  Last I heard Jamtar Mantar (meaning maya type thing in Telugu) is looking like a mala with less than thousand people.

Earth shattering movement indeed.   

News of support to Anna from around the nation is being reported on all TV’s and papers. Of course all you need is a couple of dozen people in front of a Camera to say that entire 1200 million Indians are participating in the protest of Anna.

Jholawalas in NAC seemed to be bit concerned that they are not getting Tv time and thus power to get donations is slipping from their hand. How costly is to have our reporters there) is not news at all.

So make way for 21st century Ganthi and his gang of neo liberators boys. There is some time gap for IPL and we need some thing hot and spicy for our viewers.

Poor MMS who till recently busy covering Raja’s and Kalmadis ( or is it Italian gang?) etc is now busy answering Annas of this world as he lacked guts to withstand Jhola gangs  made larger than life figures by day and night news coverage. He had to brief the President of India on this and Sonia has also graced his office. (I am not sure if she graced his office or he attended her at her house) There was some cabinet meetings also.

Kapil Sibbal has started discussions with the Super Busy Swami Agnivesh ( please don’t ask me Swamy of what) and one more person ( My lack  knowledge about the Jholagang is really shameful and will try to improve it in future) and live coverage of each round.

Suddenly all this drama ended with MMS agreeing to the demands of Anna. Incidentally IPL also started at the same time. So the time gap entertainment show is over for some time. Wait carefully for some time till next empty slot in the TV show time.

Telangana - Resolution in Parliament


Let us see the provisions of the constitution relating to formation of any new state etc. The relevant provisions are :

Article 3.

Parliament may by law—

(a) form a new State by separation of territory from any State or by uniting two or more States or
parts of States or by uniting any territory to a part of any State;

(b) increase the area of any State;

(c) diminish the area of any State;

(d) alter the boundaries of any State;

(e) alter the name of any State:

Provided that no Bill for the purpose shall be introduced in either House of Parliament except on the
recommendation of the President and unless, where the proposal contained in the Bill affects the area, boundaries or name of any of the States, the Bill has been referred by the President to the Legislature of that State for expressing its views thereon within such period as may be specified in the reference or within such further period as the President may allow and the period so specified or  allowed has expired.

Explanation I.—In this article, in clauses (a) to (e), "State'' includes a Union territory, but in the proviso,
"State'' does not include a Union territory.

Explanation II.—The power conferred on Parliament by clause (a) includes the power to form a new State or Union territory by uniting a part of any State or Union territory to any other State or Union territory.


I have gone through the law books available with me and as per the decisions of the Supreme Court this power of the Parliament is quite wide. But the process itself can not be by passed. So in the instant case, if the Central Government want to divide AP it has to prepare and approve a draft resolution in the cabinet and then send it through President of India to AP Assembly for its view. A reasonable time should be given to AP Assembly to provide its views. Thereafter the views of the resolution along with the views of the AP state Assembly shall be put before Parliament for its consideration. A Simple majority is sufficient for the passing of bill.

Historically when our republic formed there were huge number of princely states etc and entire set up was created by British for their imperial purpose. So a simple process and complete power was given to the Parliament for the reorganization of the state. Further at that time very few of the members of the constitutional assembly members can be termed as a true federal supporters. This is because of the historical background under which they lived wherein the predominant fear of uncertainty and fear of dismemberment of the republic itself. Such fears were invoked by the Delhi establishment whenever some strong regional political force is formed to oppose it.

There are broadly 3 or 4 waves of state reorganization in the history. They are: 

  1. On the linguistic basis.
  2. Division of Maharashtra and Punjab etc.
  3. Various north eastern states
  4. Recent division of the 3 states.

Though INC initially agree for the creation of the separate states in early 1900’s it basically went back and opposed the same. They even formed committees for that with Nehru and Patel etc and decided against it. But the desire for the Telugu people to have a state of their own was quite strong and Andhra Maha Sabha was formed in some wherein 1910 (1912?) Huge movement for a Telugu administrative unit was there even before Independence. Mind you this is not to have a nation but to have a state within any India nation. So this movement from the start is the desire of the Telugu people to retain their own unity which was lost when the Kakathiya Empire fell so long back. Though there was unity under Nizam, many may not know that under Nizam one can not speak with Telugu in any public meeting and no Telugu education was given.  So naturally the people wanted to have their own linguistic province.

Yet Nehru was against the Telugu people having a state on simple linguistic basis. When asked by some Press fellows ( Yes this evil was there then also) that when are we going to get a Andra State he famously said “ Is it in my Pocket” When there was no response from Delhi for the demand of a separate state for Telugu people living in Madras province, Sri Potti Sriramulu, a gandhian worker went into hunger strike  till death. Here we need to know something about him. He belong to Nellore and follower of Gandhi. He always used to wear card boards on his chest and back with slogans written against evil things like Untouchablity. Many times children used to through stones on him. Yet he never stopped this practice. He was not a big leader of Congress at that time and held no political positions. He never aspired for them. There was no response from Delhi for this hunger strike and he died after some 58 days. The death of this Gandhian resulted in serious disturbances in the Telugu areas and as a result Nehru had to bend and Andra Rastram was formed with Karnool as capital. Later, when the Fuzal Ali Committee had given its report AP state was formed during the reorganization of the states on linguistic basis.  

The Telangana areas in Hyderabad province were merged into AP and such action had overwhelming support of the then Assembly of Hyderabad province.    The so called gentle men agreement is an agreement between congress leaders of both the sides and no other political parties were involved. Out of the people who are party to them most of them later became CM’s of the AP and PV Narasimha Rao and Neelam Sanjeeva Reddy even became PM and President respectively.   

In this back ground, in case we want to have a separate Telangana state ,Union Government is required for follow up the process as above. Now as per the demands of the KCR and other politicos no resolution will be even moved in the state assembly. Such action will be in violation of the Article 3. If there is any resolution put in the Assembly it will be defeated. If the word is only about the opinion and no resolution even them the opinion will be negative. So basically the Parliament has to disregard the rejection of the AP State Assembly and pass a resolution dividing the state. Such division has no logical reason. With SKC not accepting the development reason, there is no development reason; there is no cultural and linguistic reason. So what will be the reason for the division of the state? I wonder if the division of the state can be made solely for political convenience of the present day political dispensation at Delhi with no regard to the views of the local people who are affected.

If such actions are agreeable then every new ruler with simple majority in Parliament would like to have new states as per their political or looting requirement and we will have new states created all the time either by dividing existing states and merging them into one other. So the entire structure of states will become adhoc and solely dependant on the whims and fancies of people like Rajamata. For example since only a simple majority is sufficient Rajamata to create entire set of states with the places wherein they will be in power. So divide states say like Gujarat where she and her cronies are finding it difficult to come to power and form new state with places which will vote for her gang.  Further whenever some set of politicos become unemployed like Ajit Singh, KCR, and others they take up demands for news states and raise emotions.

But in the case of AP, does Rajamatha has political will to proceed with the division of the state inspite of the opposition from the majority in the AP state?  I don’t think it is there. There is no great benefit to her family with the division and unless she sees something big to gain or she is totally mislead like when happened in December 2009 she will not do it. Remember if she agree to this there will be dozens of similar demands else where and what will happen to make rahul baba PM in 2014?

It is surprising that Telangana vadis are asking for the bill to be put in parliament in the coming Budget Session of the House. It can not be simply done like that. The process involved is already mentioned by me above.  Does there people do not know this? They know it very well and yet lying to people. Most unfortunate.

Telangana agitation - Stupidity and lack of pride in Telugu people


For a long time there was no opposition to Congress in AP. Even in 1977 election Congress won 72 seats in the entire country. Out of that 41 were won by the in AP (which has only 42 seats) only one seat of Ananthapur was won by Neelam Sanjeeva Reddy who later became president.  Indira Gandhi contested elections in 1980 from Medak in Telangana Region and won. But what happen since 1982 Congress was out of power most of the time and humiliated with 26 seats in 1994 elections. The reasons are many like bad governance, political instability during their rule, corruption and mainly their utter disregard to the feelings of the Telugu people.

In 1977 Chenna Reddy became CM of AP.  It is the same Chenna Reddy who wanted to divide the state and have Telangana in 1969. Under him corruption reached it highest point till that date. In about two and half years he was kicked out from CM post and was replaced by Sir P. Anjayya. Anjayya is a down to earth man and like by many people across the state as a person. His manner of speaking Telugu which is rural Telangana was refreshing and his repeated statement that he was a 6 anna kooli in the start and came up by hard work made him lovable and near to public. Though many joked about him but it is more because the liking they had for him and not otherwise. Unfortunately it is during his tenure, one of the least reported (at least in national level) incidents which had a great impact on the state level politics has taken place.

Rajiv Gandhi joined politics and was being treated like a crown prince in waiting. He was also made General Secretary of the Congress party.  He was visiting Hyderabad and P Anjayya who was the CM of the State met him in the Airport. Rajiv Gandhi totally disregarded the fact that he has speaking with the Chief Minister of a Major state insulted him publicly in a very bad manner. Fortunately for Congress at that time there were no Television Cameras at that time. This insult to the State CM was reported widely in AP newspapers (there were no TV’s then) for many Telugu people including to those people who routinely voted for congress during their entire life this was a great insult.

Suddenly every one started to see all the political happenings in the state in a deferent angle. People saw the disgusting manner in which their state CM appointed and removed by sending sealed covers. Every one can see the disregard for the public feelings and administrative requirements in the rulers.  Congress MLA’s waiting at Delhi and Hyderabad like beggars for the Minister posts or even for a mere glance from the High Command is quite a humiliating site. Entire political set up in the state is reduced to a gang of baggers waiting before the Delhi rulers, and people got fed up.

It is this situated which was well utilized by NTR. He started Telugu Desham Party in 1982 and his slogan was “self respect” of Telugu people. It was resonated well with public mood of that time. People simply fed up with 4 CM’s 5 years of congress and full time spent by all the congress MLA’s begging for Minister Posts and quarrelling among them all the time. This has resulted in congress getting wiped out by within 9 months of the birth of TDP in the state assembly elections. 

I had attended one meeting addressed by Mrs. Indira Gandhi in my home town wherein the Congress MP got the highest majority in the country in 1980 general elections and there were only some 3 to 4 thousand people mainly educated class who attended may be as a mark of courtesy to the PM visiting their town. It is in the same ground people stood for 24 hours at a length in their tens of thousands to see NTR.

Congress faced humiliation in elections time and again after that and till YSR won in 2004 Congress has won only one election to assembly from 1983 to 2004. Even then and till date they have not learned to respect Telugu people and then them won one term in 1989 they have once again changed 3 CM’s and were promptly reduced to 26 seats in 1994.

Now Congress once again is playing with Telugu people. It has created TRS to check mate TDP which has a strong base in Telangana so that it can come to power after 10 years. Immediately after elections Telangana was simply ditched. CBN also rank opportunist and promptly allied with TRS and lost miserably in 2009. 

With the death of YSR, the Italian family has appointed Rosayya knowing his age and limitations so that they can control AP with remote from Delhi. Even when KCR done his hunger strike they have by passed and completely disregarded the CM of the state to announce the start of process of forming the Telangana state. The state CM who was traveling back to Hyderabad from Delhi had to know it after it was announced.

When Rosayya who was never meant to be a strong leader as per congress calculations themselves failed to contain the problems in the state he was removed. In fact he was asked to come to 10 Jana path from backdoor and told that he should resign immediately showing health reasons. This is done to a person loyal to the Italian family for decades. 

Now they have appointed Kiran Kumar Reddy who is a speaker and had no previous exposure as CM. This was done when they have other more experience leaders who can do better job. If the news reports are to be believed his name was picked by Rahul because Azar had recommended his name. Let us not forget it is the same Azar who with his mafia gang connections neck deed involved in match fixing and banned from Indian Cricket for life. Now he is Congress MP from UP.  Kiran Kumar Reddy a former Ranji player from Hyderabad had played with Azar and both are friends.  So on Rahul Baba selection he was appointed. If Indian Cricket selectors are jokers then what shall we have to call Rahul?

Is this the manner the state CM is elected by legislators and that too at such a serious situation? Does Delhi care for AP state, Telugu people and their development?  Surely not. In 1 and ½ years we have 3rd CM for the state. And already there is a talk of changing him and bringing a Telangana CM. If it happens then that person will be 4th CM in two years. The only Congress CM who finished 5 year term in my memory is YSR. I don’t think any one from AP can even remember the name of other congress CM last did it.  Are we so weak that we can not even have a single CM for five years.

In 2009 Congress won 33 out of 42 MP seats in AP, mostly because of YSR and his gang “management” skills and his popularity.  Yet no importance was given to AP in any situation. But there is only one Cabinet minister from AP. No important ministry is held by any Telugu man or women now. When compared to Karnataka (congress got some 4 searts there) and Tamilnadu the power in the hands of Telugu people in Delhi is nil. Earlier this condition may be a deliberate thing on the part of YSR (Similar thing done by Chandra Babu Naidu when he was supporting NDA who prevented any one joining central cabinet so that no one challenge his grip) Yet with no presure from such leaders also same conditions continue today also.

Congress leadership should have tried to grow some leaders from the state. But the Italian family always keep AP congress men and women in the begging conditions.

Even in the resent cabinet formation Congress MLA’s begging in Delhi once again for minister posts. This was happening when the state is undergoing serious cyclone, heavy and untimely rains and farmer deaths etc.  In such a bad conditions the present CM was in fact busy attending Congress plenary at Delhi.

I felt happy seeing the revolt in the Congress MLA’s and MP’s of Telangana region (and also in TDP) and subsequent backtracking by Delhi bosses showed to AP Congress gang that they need not be always beggars before High Command. The failure to contain and retain Jagan for whatever reasons, his revolt and fear shown by Delhi in taking action against him showed every one that if the local leaders with popular issues can put pressure or even defy High Command.  This should have at least installed courage in all the MP’s and MLA’s from Telangana areas. Still the congress MP’s reportedly wept, fell on the feet of Pranab Dada.

At the feet of Pranab Dada and hugged his feet with folded hands and weeping eyes. Even Madhu Yashki who all along very agreesive in abusing all the non Telangana Telugu people wept. It this the pride and confidence of the leaders who gave insulting words on all non Telangana people ? What was the need for them to beg before the feet of Pranab Baba or any one like that? Don’t they have confidence in their so called cause and public support it enjoys.

The reality is none of these people have any public following and but for Congress party and more importantly YSR popularity none of them can even win a municipal counsel seats. 

Here also the bad condition of our leaders  of the INC is evident. Should they be  reduced to this kind of helpless condition. The Home ministry knows that they are not going to give Telangana. I am sure the present governor has given clear report on the security implications on the division of the AP long back. When they know about this for some time why they have not asked their MP’s and MLA’s to tone down their rubbish talk so that they dont made look like fools by their own party.  What is the need for INC to kick Jagan at this critical period when they know that he controls a powerful financial and goonda empire with lot of support from general public. Is reduction of Jagan’s influence is so important to INC at this stage when serious agitations on division of the state and for united state going on. Cant they keep at least their own leaders united.  

Almost every political party in AP is behaving like this. It is disgusting for us to see Bandaru Datthathreya a former BJP central minister sitting long with the Naxal traitor Gaddar and singing the same tune. Is this level Telugu leaders of the BJP which is suppose to have some principles stoop for some imaginory benifit under a new state which may never come into being. Can they be trusted to fight naxals tomorrow if Telangana is given ?  True that BJP stand for small states but they also divided the states when every one agreed for the same. Here there is no such condition. Why are not recommending for division of Gujarat now ? Why they have kept quite about Telangana during NDA rule. The support to Telangana is only done when its benefits to them.

CBN is not so innocent here . It is his pact with KCR and change of long held stand on united state is responsible now for his pathetic state.

Just like JP said on the other day none of the Telugu political leaders children are disturbing their life and educations for this agitation. Then why any other people should do any agitation? When these people can not win 10 seats seriously out of some 50 contested by them should we accept they have public support for their demand and follow them?

In fact now other than naxal infested Art college people who continue there on scholarship funds none of the common and serious students are involved in the agitation in the first place. They don’t have time for this kind of irrelavent ideas. Telugu people lost 2 years of development work. Let us stop this stupidity and get on with development of the state and Telugu people. We all know politicos lie all the time. Why should we believe them now?

Telangana and Sri Krishnam Report - Uncertainity Continue

Justice Sri Krishna Committee which is not a commission under Commission of Enquiries Act, but an internal Home Ministry committee has submitted its report in time as promised to the Ministry. Though we do not know what they have reported we must congratulate them on a time bound action. The Home Minister has arranged on 6th Jan 2011 and called all the local political parties in AP for consultations. It is inconceivable that Congress leadership does not know what is there in SK Report now. So this attempt to listen to the local political opinion afresh without even giving the report in to them advance or without allowing them time to think about the report seems to be an idea to put blame on what ever happens on local parties like TDP. It is quite strange that the political parties from AP will not have any time to study and react to the report which will be voluminous.  One more thing is to call two people from each party which will result once again in division of the opinion.

One wonders if Chidambaram and Congress are once again playing too smart like December 9th for their own good.  If the Home Minister and Congress want an alibi to take any decision he is not going to get and political parties from AP are not going to provide that to him. Already KCR and TRS made clear that will not be attending this meeting. KCR obviously don’t want to be part of consultations which may end up not giving Telangana state. If Telangana is not given now he can take a high ground in any future agitation and elections by not taking part in the present consultations. Already Telengana leaders from TDP are urging their party to boycott the meeting. PRP is saying that only one person from each party should be called. So the meeting on 6th Jan 2011 may not even be attended by important factions.

Present government in AP may last till some decision by Congress on Telangana or till it enjoys pleasure of Jagan.  Jagan is waiting for a suitable time for successful action of removal of AP Government. But he will prefer it to fall on its own and if Congress accepts formation of Telangana without clear SKC report then that will provide required pretext to his supporters to quite their seats in the assembly thereby bring down the government in AP. He may or need not stop at that. We need to remember Non-Telnagana regions have 22 Congress MP’s in Lok Sabha whereas Telangana region got just 11 Congress MP’s. This 22 will be under threat from public and will be forced to quite due to public pressure and Delhi Government may fall as a result. Jagan may force this matter at least to teach a lesson to Congress for continuous attacks on him from the old retainers of the Italian family. Even today V H Hanumatha Rao attacked Jagan and insulted him on TV.

There are also reports that Sharad Pawar is trying to mediate between Congress central leadership and the Jagan group now.

The division of the state requires resolution from the AP assembly. The constitution says that it is required to obtain the opinion of the house which in turn means voting. Naturally any resolution for the division of the state will be defeated in the assembly. It may not be compulsory for the Parliament to accept the decision of the state assembly and Parliament can decide for the division against the wishes of the state assembly.

But here is on clear catch. The division may also end up in Supreme Court. It had held at the time of the Gujarat state formation that the consent from the State Assemble is not compulsory and only its opinion is need and state can be divided against the wishes of Assembly. But this very old position is taken when the center government is more unitary in nature and the India was still under formation. The division of united Maharashtra State was on the basis of language and all over India such states were formed at the same time. So there is some basis for the division of the state. The present constitutional condition is towards more federal structure and there is no pan Indian basis or rule under which Telangana can be given. So any case before Supreme Court may not be an open and shut case and Gujarat decision may even be reviewed by it. More important thing is the basis of the division of the state. SKC may provide some basis for division. But if it does not, then how can the Union Government justify the division of the state in any court.  If the court asks - What is so special about Telangana when such demands are there everywhere in the country? – What answer Delhi can give?
